Menacing by Stalking Penalties in Ohio

In its baseline form, menacing by stalking is a first-degree misdemeanor carrying up to 180 days in jail and a fine of up to $1,000. The charge escalates to a fourth-degree felony when aggravating factors are present, which can mean up to 18 months in prison and a fine of up to $5,000.

Aggravating factors that can trigger the felony level include:

A prior conviction for menacing by stalking or aggravated trespass
A threat of physical harm made during the offense
Trespass at a location where the victim lives or works
The victim being a minor
A history of violence by the offender

Two related charges carry their own penalties. Menacing under ORC 2903.22 is a fourth-degree misdemeanor in baseline form, carrying up to 30 days in jail and a $250 fine. Aggravated menacing under ORC 2903.21 is a first-degree misdemeanor in baseline form, with penalties matching those of the baseline stalking charge.
