O.R.C. 2903.211 Menacing by Stalking


Menacing by stalking is where a person by means of a pattern of conduct knowingly causes another person to believe that the offender will cause physical harm (or threats as seen in menacing) to the other person or cause mental distress to the other person. For this crime, this is your run of the mill “stalker” that follows someone home day after day after making threats to them.

This crime is punishable by a first-degree misdemeanor, however depending on the status of the parties involved, if the offender has other felonies, if the offender trespassed onto the property of the victim, if the stalking was sexually motivated, if the victim was a minor, or along with other aggravated circumstances found in the statute, the crime can be elevated to a fourth-degree felony.
