Ohio BUI Law: What ORC 1547.11 Covers

Boating under the influence in Ohio is governed by ORC 1547.11, a statute separate from the OVI law at ORC 4511.19. It applies to any vessel on state waters, and Ohio defines vessel broadly: motorboats, sailboats, personal watercraft, jet skis, and water skis or aquaplanes all fall within its scope. The BAC threshold mirrors the road standard, 0.08% or higher for adults 21 and over, and 0.02% or higher for those under 21. The statute also prohibits operating with a prohibited concentration of specific controlled substances, including cocaine, marijuana, amphetamines, heroin, LSD, methamphetamine, and PCP.

Two distinctions from the OVI statute matter to most clients. First, BUI requires the vessel to be underway. A vessel securely attached to a dock or anchored in a designated anchorage is generally not subject to the statute. Second, a BUI conviction does not suspend a driver’s license. Ohio doesn’t require an operator’s license to run a recreational vessel, so the suspension mechanism that applies to OVI doesn’t carry over. Open containers and passenger alcohol consumption are also permitted on anchored or moored vessels. Only the operator is prohibited from being impaired while underway.

How BUI Investigations Work on Ohio Waterways

Local law enforcement, including city marine police, county agencies, the Ohio State Highway Patrol, and the Ohio DNR Division of Watercraft, must have probable cause before stopping or boarding a vessel. Officers may make contact after a complaint from another boater, observation of erratic operation, or a routine patrol encounter. The U.S. Coast Guard can conduct safety checks without probable cause, but sobriety evidence gathered during those checks can still be contested.

Once contact is made, the investigation follows a pattern familiar from OVI cases: field sobriety tests and potentially a breath, urine, or blood test. The key difference is the testing environment. Standard standing balance tests are scientifically invalid after time on the water because vessel motion disrupts equilibrium, a phenomenon known as sea legs. Officers trained in BUI investigation use the NASBLA Seated Battery, a set of tests developed by the National Association of State Boating Law Administrators to assess cognitive impairment and fine motor control without relying on balance. If officers want to administer standing tests, Ohio requires them to wait at least 15 minutes after the subject has returned to land.

Environmental factors can complicate the picture further. Sun glare, heat exposure, and physical fatigue from time on the water all produce symptoms that can resemble intoxication: flushed appearance, unsteady movement, and slowed responses. These factors are directly relevant to how an investigation is evaluated and can be used to challenge an officer’s observations.

Ohio’s implied consent law applies on state waterways. Operators are deemed to have consented to chemical testing, and refusing a test after a BUI arrest results in a 1-year prohibition on operating or registering any watercraft, enforced by the Ohio DNR Division of Watercraft. If the person owns the vessel, the registration certificate and tags are impounded.

BUI Penalties in Ohio

Mandatory minimums and maximums under Ohio law depend on prior offenses within the lookback period.

• First offense: Mandatory minimum 3 days in jail or completion of a driver intervention program; minimum $150 fine; maximum 180 days in jail and a $1,000 fine, plus up to 5 years of community control
• Second offense within 10 years: Mandatory minimum 10 days in jail; minimum $150 fine
• Third offense within 10 years: Mandatory minimum 30 days in jail

Refusing a chemical test triggers the separate 1-year watercraft operating prohibition described above. A BUI conviction does not suspend a driver’s license. The criminal record, however, is permanent and appears on background checks for employment, housing, and professional licensing.

In some cases, a negotiated resolution to a charge of reckless or unsafe operation of a vessel under ORC 1547.07 may be a possible outcome. That charge is a fourth-degree misdemeanor carrying a maximum $250 fine and 30 days in jail, with no mandatory penalties and no alcohol-related designation on the record. Whether this resolution is available depends on the facts of the case and the prosecution’s position. It isn’t guaranteed in any case.
