Felony Community Control Violation Ends In Reduced Sentence

Client was found guilty of two counts of possession of heroin, felonies of the 5th Degree under ORC 2925.11. Client received a community control sanctions as a part of her sentence with 21 months in the Women's Reformatory (Prison) being suspended. Several months after the client started serving her community control she relapsed and tested positive for drugs. The prosecutor in this case wanted the Defendant to serve out her time in prison; however, Attorney Zachuary Meranda argued that his client need drug treatment/rehabilitation and NOT Prison. After having the client screened and accepted into a Drug Treatment program the Court concurred with Attorney Zachuary Meranda and ordered her to complete said program instead of sentencing her to a term of imprisonment.
