O.R.C. 2903.08 Aggravated vehicular assault; vehicular assault

These crimes are, in a most rudimentary sense, the serious physical harming of another while the offender was:

"...operating or participating in the operation of a motor vehicle, motorcycle, snowmobile, locomotive, watercraft, or aircraft."

This can be shown by proximately causing another's death in a reckless manner. Aggravated vehicular assault is where the operator was under the influence of drugs or alcohol at the time of operating one of the crafts above.

Vehicular assault is the accidental serious physical harming of another proximately caused while operating or participating in the operation of a motor vehicle or motorcycle in a construction zone, or where the reckless manner proximately caused the serious physical harm in the same zone.

The crime of aggravated vehicular assault is punishable by third-degree felony. The crime of vehicular assault is punishable by fourth-degree felony, however can be enhanced to a higher-level felony for other traffic violation crimes.
